Kutai Regent's Employee Faces 20 years

Samsuri Aspar, an employee of the Kutai Regent, Kartanegara, East Kalimantan, is facing a sentence of 20 years imprisonment. Corruption Eradication Commission (KPK) prosecutor Zet Tadung Allo, accused Samsuri of corruption involving Rp 23.134 billion from the Kutai 2005-2006 budget allocated to a social assistance post.

“The accused, Samsuri, in collaboration with Setia Budi, a member of the Kutai Regional House of Representatives (DPRD), personally profited and caused others to profit (from corruption),” said Zet when calling for this sentence at the corruption court yesterday. The prosecuting attorney considers the accused to have violated article 2, section 1 of the Corruption Eradication Law which carries a maximum sentence of 20 years imprisonment.

Prosecutor Zet explained that this case began with an allocation Rp 19.7 billion of funds to the social assistance post from the 2005 and 2006 budget. Yet this money was directed instead to the pockets of DPRD members. “The accused also requested a share of the funds,” said Zet.

The prosecutor explained that during November 2005, members of the DPRD, Setia Budi and Khairudin, requested Rp 18.5 billion. Samsuri, the prosecutor claimed, immediately approved the use of funds from the Kutai Kartanegara Budget that had been allocated to the social assistance post.

According to the prosecutor, the accused, Samsuri personally pocketed Rp 1.95 billion. Money was also channeled to 35 members of the Kutai Kartanegara DPRD including Rp 1.78 billion to Setia Budi. “(Other members) each received Rp 375 million,” he said. Setia Budi is currently facing the same sentence in a separate court trial.

In response to the proposed sentences, the two accused stated that they raise no objections. “We feel we do not need to object,” said Yonas Sihaloho, Setia Budi's lawyer. The following court session will proceed on 19 November 2008.
